Questions About Family Law

Monday, November 29th, 2010

What areas does family law cover?

Family law includes a variety of family situations, as well as domestic issues. The Law Offices of Anthony Carbone, P.C. handles divorce cases, child custody issues, division of assets, child support and Department of Youth and Family Services (DYFS) cases. If you are going through a divorce, we can answer your questions regarding child custody issues and division of assets. Attorney Carbone will fight hard to get you everything you are entitled to following the dissolution of your marriage.

What is a no-fault divorce, and do I need a family attorney?

A no-fault divorce is one in which neither person blames the other for the breakdown of the marriage. There are no accusations or need to prove “guilt” or cause of the breakdown. A common basis for a no-fault divorce is “irreconcilable differences” or “irretrievable marriage breakdown.” Another common basis for no-fault divorce is the parties living separately for a certain period of time, such as for six months or a year, with the intent that the separation be permanent.

Can a family lawyer guarantee the mother will get custody of the minor children?

Unfortunately, there are no guarantees in family law. However, we can guarantee that we will work very hard to get you the assets you deserve, and if you are the fit parent, we will argue your case to the judge and/or jury to make sure the best interests of the child are met. If your former spouse is in a better position to retain custody, we can discuss visitation options with you and explain your choices for shared or joint child custody.

Some people make mistakes during their lives that get them arrested and convicted. At the Law Offices of Anthony Carbone, P.C. we have represented people in all walks of life such as doctors, other lawyers, accountants, nurses and teachers who made a mistake, got caught, and got convicted.
