We all make mistakes. Some, however, are more serious than others. Some mistakes are actually crimes that can result in conviction, loss of job, loss of family and certainly loss of a previous good reputation. If you were convicted of a felony or misdemeanor in the past, there is a very good chance that the conviction remains on your criminal record.

Many companies now regularly perform extensive background checks on prospective employees, so even an old conviction can jeopardize your chance at a job. Alimony

Thursday, April 21st, 2011

While most people believe they will be married “till death do they part,” well over 50% of U.S. marriages end in divorce. Even in amicable divorce cases, disputes over child custody, division of property, and alimony payments can get complicated very quickly. If you are going through a divorce in Jersey City or Newark, New Jersey, family law attorney Anthony Carbone can advise you on how to proceed. Anthony Carbone will fight diligently to ensure you receive the financial compensation from your spouse that you are entitled to once your marriage is over.

Alimony is the amount of money one party in a divorce pays the other to ensure that their standard of living can be maintained after the marriage has ended. Temporary support is money paid by one spouse to the other while their divorce goes through the court. Both alimony and temporary support can be paid directly or through New Jersey Probation. In most cases, alimony is taxable to the party receiving it and deductable to the payer, while temporary support is usually non-taxable.

There really is no set formula to calculate how much alimony you can collect. All divorces are different, and alimony payments depend on multiple factors such as income, assets, length of marriage, and so on. Our divorce attorneys understand everything that goes into a fair alimony settlement and will work to ensure you get the support you deserve.

If you are going through a divorce and live in New Jersey, please contact the family law attorneys at Law Offices of Anthony Carbone, P.C. today to schedule your initial consultation.

Annulment

Tuesday, April 12th, 2011

Under the right circumstances, a marriage may be deemed legally invalid, a process which, in effect, erases it as if it never occurred in the first place. This process differs from divorce and legal separation and requires specific criteria to be met. An experienced family law attorney can advise you of what is necessary to seek an annulment in the state of New Jersey.

An annulment is a legal process that dissolves a marriage by declaring that it was never valid in the first place. An experienced family law attorney such as Anthony Carbone, serving Jersey City and Newark for over 20 years, can advise you on how to proceed with an annulment or tell you whether or not you qualify for one.

A common misconception among most people is that a short marriage may be annulled. However, the length of the marriage does not automatically qualify it for annulment. Annulments are granted usually because of some fraudulent factor that occurred at the time of the marriage. Examples of this include:

  • If one or both parties were minors at the time of the marriage and got married without parental consent
  • If the parties are closely related by blood
  • If one of the parties was already married
  • If one of the parties was mentally incapacitated, as in a case of drunkenness or other mental disability

An annulment may also be granted if the marriage was never consummated. A marriage entered into by force, duress, or threat is also grounds for annulment. Another reason a marriage may be annulled is if one of the parties has a criminal history, an undisclosed sexually transmitted disease, or is impotent.
