Premises Liability

Monday, June 27th, 2011

A premises liability lawsuit is when a person seeks compensation for injuries sustained on another person’s property that they believe are due to the negligence of the property owner. The most common type of premises liability lawsuit is what are known as “slip and fall” accidents, but other types of premises liability lawsuits include negligent security and swimming pool injury or death.

Slip and fall accidents and negligent security lawsuits stem from a common law premise that if a person invites you to their property, they have a responsibility to exercise due diligence in ensuring your safety. This includes being aware of and eliminating hazards such as wet floors, broken steps, or security hazards. The due diligence standard is generally central to a successful premises liability lawsuit, and states that a normal person being reasonably aware of the condition of their property, should have known about a hazard and therefore should have acted to rectify it.

Swimming pool injury lawsuits hold property owners to a stricter standard. In these lawsuits, the injury stems from the property owner’s failure to protect the public from a hazard on their property. Because swimming pools represent a high potential for injury to children and other unsupervised swimmers, swimming pool owners have a responsibility to take a number of important precautions, such as tall fences, locking gates, and other security measure that represent a reasonable attempt to keep out unauthorized swimmers.

If you have been injured due to a property owner’s negligence, you may be able to receive compensation for your injuries, including compensation for medical bills and lost wages. To learn more, please contact the Law Offices of Anthony Carbone, P.C. today to schedule a free initial consultation.

Truck Accidents

Tuesday, June 7th, 2011

In accidents involving large commercial vehicles, the responsible party can range from the trucker himself to the company he works for and even the company he was delivering to. All of these people will have attorneys and insurance agencies working around the clock to try and keep you from getting the compensation you are due. Only with the help of a relentless Hudson County truck accident attorney can you ensure you are not cheated out of the full amount you deserve.

Sadly, truck accidents frequently result in serious injury and even death. The weight and size of commercial vehicles makes them a potential hazard to everyone on the road. Because of this, the Federal Motor Safety Administration has placed special regulations on truckers, but unrealistic demands and trucker irresponsibility often see these regulations ignored.

When a trucker causes an accident, the end result is all too often debilitating injury for the driver and passengers of smaller vehicles. These injuries can impact your ability to work and have a tremendously negative impact on your quality of life.

When you are seriously injured by a commercial vehicle, you have a right to seek compensation for damages including lost wages, medical expenses, and pain and suffering. Going up against the insurance companies alone almost always results in unfair and inadequate compensation. With 20 years of experience fighting insurance agencies and holding negligent truckers accountable, attorney Anthony Carbone can help you get the full compensation you are due.
